Can I use Google Gemini output commercially?
Last updated
TL;DR: Generally yes. Google's Terms of Service (effective July 30, 2026), which cover the Gemini app, say that when a service lets you generate original content, Google won't claim ownership over it. The Gemini API Additional Terms (effective March 23, 2026; Gemini API and Google AI Studio) say the same, add that Google may generate the same or similar content for others, and make you responsible for how you and anyone you share it with use it. On Google Cloud's Gemini Enterprise Agent Platform (formerly Vertex AI), Generated Output is your Customer Data and Google asserts no ownership in it. The limits: you can't use Gemini output to build machine learning models (consumer terms) or models that compete with Google's (API and Cloud terms), the Generative AI Prohibited Use Policy applies everywhere, and Google can't hand you a copyright the law doesn't recognize.
What should I check, step by step?
1. Work out which terms you're under: the Gemini app with a personal account (Google Terms of Service), the Gemini API or AI Studio (API Terms plus Gemini API Additional Terms), or Google Cloud (Cloud terms and Service Specific Terms).
- Check that you aren't using the output to train or improve AI models. The consumer terms forbid using AI-generated content from Google's services to develop machine learning models or related AI technology; the API and Cloud terms forbid competing or similar models.
- Read the Prohibited Use Policy against your use: no infringing others' IP or privacy, no impersonation to deceive, and no claiming generated content was made solely by a human in order to deceive.
- On the free tier of the API or in AI Studio without billing, don't send confidential material: Google may use prompts and responses to improve its products, and human reviewers may read them.
- Serving users in the EEA, Switzerland or the UK through the API? The terms say you may only use Paid Services for that.
- Using Grounding with Google Search? Its results come with their own display rules, and you may not cache, resell, train on or build an index from them.
- Need enforceable ownership of a logo, book or code? Add substantial human creative work and keep the drafts; in the US, material generated from prompts alone generally isn't protected by copyright.
- Keep a record: which product and plan, the date, the prompt and the exact output you used.
Gemini app vs Gemini API vs Google Cloud
Gemini app (personal accounts): the Google Terms of Service apply. Google won't claim ownership of original content you generate, and the terms prohibit using AI-generated content from Google's services to develop machine learning models or related AI technology. Google's Gemini Apps Privacy Hub says chats may be reviewed by people and used to improve Google services depending on your Keep Activity setting; temporary chats and chats with Keep Activity off are kept for 72 hours and not used to train models.
- Gemini API and Google AI Studio: meant for professional or business use by developers aged 18 or older, not consumer use. Google won't claim ownership of generated content but may generate the same or similar content for others. Unpaid use (AI Studio, free API quota) may be used to improve Google's products, with human review; Paid Services aren't, apart from limited logging for abuse detection.
- Google Cloud (Gemini Enterprise Agent Platform, formerly Vertex AI): Generated Output is Customer Data, Google asserts no ownership in new IP created in it, and Google won't train on Customer Data without permission. Output may not be used to substitute for a Google model or to create or improve similar models.
Does Google defend you if the output infringes?
Only on Google Cloud. The Service Specific Terms extend Google's indemnity to claims that unmodified Generated Output from a Generative AI Indemnified Service infringes third-party IP, for paid use. The list (last modified July 20, 2026) includes the Agent Platform API with generally available Gemini, Imagen and Veo models, Gemini Enterprise and Gemini in Workspace.
- Exclusions include output you knew or should have known was likely infringing, disabling or circumventing citations, filters or other tools Google provides, using output after an infringement notice, and trademark claims from using output in commerce.
- The Gemini API Additional Terms contain no such output indemnity, and the Gemini API through AI Studio isn't on that list.
Rules for apps and agents built on Gemini
Don't use the API in services directed at, or likely to be used by, people under 18, and don't use it for clinical practice or medical advice.
- For agentic services such as the Computer Use API, you're responsible for what the agent does, and the terms say you will not automatically bypass requests for human confirmation.
- The Prohibited Use Policy also bars automated decisions with a material detrimental impact on individual rights in high-risk areas like employment, finance and housing without human supervision.
How do I ask Rightshold about this (free, no key)?
Add the MCP server https://www.rightshold.com/mcp to Claude, Cursor, ChatGPT, Grok or VS Code, then ask: “We generate product descriptions and images with the Gemini API on a paid Cloud project. Can we sell them, and what do Google's terms require?”

}- Free. Point source_url at the terms page you're under and Rightshold explains what it allows; it doesn't see your Google account, prompts or outputs.
- issue_rights_receipt (with an API key) binds a file's SHA-256 to the terms and intended use you record, signs it and commits it to the ledger, so you can later show what you relied on and when.
- check_rights_batch checks every text, image, font and package in a project in one call before you ship.
