Can I use AI-generated images commercially?

Short answer: Usually yes, if the tool you used allows it, but two limits remain. First, you may not own a copyright in the image: the U.S. Copyright Office's position, upheld by a federal appeals court in 2025, is that copyright needs a human author, so material generated wholly by AI is not protected and others may be free to reuse it. Second, permission from the tool does not clear what the image shows: a recognizable person, logo, trademark, character or copied artwork can still infringe. Check the generator's terms, inspect the image, and keep a record of how it was made.

Checklist

  1. Read the generator's current terms on output ownership and commercial use, including any plan tier or company-size condition; save a dated copy.
  2. If you run an open model yourself, check the model's license: OpenRAIL-style licenses carry use restrictions that pass to whoever uses the outputs or the model.
  3. Inspect every image for recognizable people, logos, brand marks, characters, existing artworks and stray watermarks before it goes into an ad, product or listing.
  4. Avoid prompts that name a living artist, a brand or a character when the image is for commercial use.
  5. If you need to own and enforce rights in the image (a logo, a mascot, a product design), add substantial human creative work and keep the drafts, or commission it.
  6. Check the rules where you publish: some stock sites, marketplaces and ad platforms require an AI-generated label or don't accept AI images.
  7. Keep provenance: tool, model version, prompt, date, and any content credentials the tool attaches.

Ownership is not the same as permission

License checks (computed)

Yes means the license grants the use, on the duties listed. Duties such as source_disclosure, share_alike and network_source_offer are the ones that conflict with keeping a product closed-source.

Rightshold reads licenses and terms you point it at. It does not decide copyright ownership, and it does not look inside images.
