# Do Suno commercial rights lock in when you make the song, or can you upgrade later?

**Short answer:** They lock in when you make and download the song on a paid plan, not later. Under Suno's Terms of Service effective September 3, 2026, Pro and Premier subscribers are assigned Suno's rights in their outputs, but commercial use is allowed only for a permitted Download: a copy you downloaded through Suno's own download channel within your plan's allocation. Songs made on the free plan are for personal, non-commercial use, and Suno's help center says subscribing afterwards does not give retroactive commercial rights by default (Suno may grant them case by case, with no guarantee). Free-plan trial downloads never carry commercial rights. Once you hold a permitted Download made while subscribed, the terms say those rights are perpetual and survive cancelling or downgrading. Remixes made with Suno's remix features stay non-commercial on every tier, and Suno does not promise the song is copyrightable at all.

## Checklist
1. Subscribe before you generate anything you might monetize: Pro or Premier at the time the song is made. A song made on the free plan stays non-commercial by default even if you upgrade later.
2. Download it while subscribed, through Suno's download button: commercial use needs a permitted Download within your plan's allocation (Pro 20 songs a month, Premier 60, per Suno's downloads FAQ). Recording or stream-ripping the song is prohibited and gives no rights.
3. Don't count trial downloads: free accounts' trial downloads are for personal, non-commercial use only.
4. Keep evidence: the plan and date you made the song, the download date, the song's Suno link and a hash of the downloaded file. Suno reserves the right to mark outputs with the tier and download status, so your records should match.
5. Leave Suno's metadata alone: the terms forbid removing or altering the fingerprint, watermark or metadata that records an output's tier and download status.
6. Treat remixes separately: a remix made with Suno's remix features is jointly owned with the remixer and non-commercial for both of you, whatever your plan.
7. Check the destination's own rules: distributors, streaming services and stock libraries have their own AI-music policies, and Suno's terms say a platform's refusal doesn't change what Suno granted, but it still governs that platform.
8. Don't assume copyright: Suno makes no promise that copyright vests in an output, and the US Copyright Office's 2025 report says prompts alone don't make a person the author; your own lyrics, melodies or edits are what may be protectable.

## Why the plan at creation time matters
- Suno's terms split rights by tier: Pro and Premier subscribers get Suno's right, title and interest in outputs from their submissions, while free or basic tier users agree to use outputs only for lawful, personal, non-commercial purposes.
- Suno's help article on retroactive rights says subscribing to Pro or Premier does not, by default, give commercial licensing for songs made on the free plan; Suno may offer it in certain cases for specific songs, but that is not guaranteed.
- So the question to ask about any Suno track is: what plan was the account on when this song was made, and was it then downloaded through Suno while subscribed?

## What changed on September 3, 2026
- After settling with Warner Music Group in November 2025, Suno moved to licensed v6 models (older models are retired; existing songs stay in your library) and added download limits.
- The current terms tie commercial use to a permitted Download in your tier's allocation, and Suno's paid-plan help article now says songs downloaded while subscribed are granted commercial use rights.
- The terms also say an assignment, and the commercial rights for a Download you obtained, are perpetual and not affected by using up your allotment, later pricing changes, or the subscription expiring, being cancelled, downgraded or suspended. Suno's help center likewise says you keep rights to songs made while subscribed after cancelling.

## Ask Rightshold (free, no key)
Add the MCP server https://www.rightshold.com/mcp to Claude, Cursor, ChatGPT, Grok or VS Code (one-click setup: https://www.rightshold.com/start?ref=seo), then ask: "I made a song on Suno's free plan and upgraded to Pro afterwards. Can I put it on Spotify or use it in a paid ad?"

```json
{
  "tool": "ask_rightshold",
  "arguments": {
    "question": "Can I commercially use a Suno song I made on the free plan before subscribing?"
  }
}
```
- Free. Rightshold reads the license or terms you point it at and explains what they allow; it doesn't see your Suno account, your plan history or your downloads.
- issue_rights_receipt (with an API key) binds the downloaded file's SHA-256 to the license basis and intended use you record, signs it and commits it to the ledger, so you can later show what you relied on and when.
- check_rights_batch checks every track, image and font in a project at once before you ship.

_Rightshold does not grant or confirm Suno rights, and can't see what plan you were on or whether a download was permitted. Only Suno's terms and your account records decide that. Not legal advice._
